As followers of this blog know, Fire Business Strategies has been closely following the rollout of Minnesota’s new adult-use cannabis program.
In a positive sign for the program, last Thursday the Minnesota Office of Cannabis Management announced its intent to adopt expedited rules without a public hearing. The proposed rules can be viewed on the OCM’s rulemaking website (linked below). The 131-page proposed rules are expansive, especially for an expedited rulemaking process, covering, among other things, the long-awaited regulatory requirements for final licensure and a 70% potency cap on products.
One big benefit of the expedited rulemaking process is that these rules can be adopted right at the end of the comment period, which is, conveniently, just 5 days before the license application opens on February 18.
The drawback is that there’s not much time to make your voice heard, so the Fire Business Strategies team put together a quick guide to this comment period.
When?
Comments may be submitted beginning Monday, January 13, and must be submitted by 4:30 PM on Wednesday February 12.
Where?
The Minnesota Office of Cannabis Management encourages interested parties to submit comments electronically through the Office of Administrative Hearings Rulemaking eComments Website.
How?
On the Office of Administrative Hearings Rulemaking eComments Website navigate to the discussions panel navigate to Discussion: 40360 Minnesota Office of Cannabis Management Notice of Intent to Adopt Expedited Rules Without a Hearing. There you can find the text of the OCM’s proposed rules and type short comments directly into the comment field.
Note that all comments received will be part of the public record. So, don’t include any personally identifiable information or other information you don’t want disclosed.
